Bannockburn-Watchdog is a volunteer community of concerned Bannockburn Members. James Rogers is our spokesperson on the Bannockburn Board. Our goals are simple:
Keep Bannockburn members informed
Protect the rights of Bannockburn members
Protect the integrity of Bannockburn Bylaws and Covenants
Protect the character of Bannockburn
Monitor Board actions and failures to act
Ensure the Board act in the best interest of the Members
Force the Board to abide by the Bylaws and Covenants requirements
The various Bannockburn Boards of Directors have a long history of bad behavior, particularly when it comes to amending the Covenants. Did you know many amendments included in the 2012 Covenants were fraudulently approved and that one major change was made with no vote to do so whatsoever? Did you know that various Boards – including the 2020 and 2021 Boards – have actively worked to keep this information from you?
The only way to control the Board is with pressure from informed Members. While Bannockburn-Watchdog can send out newsletters using the US Postal Service, doing so is expensive and time-consuming. To reduce costs and provide more timely updates, Bannockburn-Watchdog requests that you provide your preferred email address with the information we need to confirm your status as a Bannockburn HOA Member. The more email addresses we have from Bannockburn Members the more pressure can apply to the Board.

The Bannockburn Board of Directors has a long history of bad behavior, particularly when it comes to amending the Covenants. Some examples:
1992– Contrary to what the Covenants allowed, the Board extended the mandated 21-day Covenant amendment voting period by over 6 months. This allowed the Board to collect enough votes to “approve” Covenant amendments. See 1992-1993 Covenant Issues for more information.
1993– In March, the Board “approved” Covenant amendments after receiving only 44 votes total, far short of the required approval by 66-2/3% of the Resident Owners. See 1992-1993 Covenant Issues for more information.
2012– Various amendment items were improperly added to the Covenants after they failed to be approved. Also, ballots of Resident Owners who had not paid their annual membership dues were improperly disqualified – something that is not allowed by the Covenants. One paragraph was replaced in its entirety with no vote to do so whatsoever. See 2012 Covenant Issues and2012 Covenant Animal Amendmentfor more information.
2012 – Two Board members falsely certified in a notarized document to Douglas County Clerk and Recorder that the various amendments had been approved by 66-2/3% of the Resident Owners, as required by the Covenants then in effect at the time of the vote. 2019 – The Covenant amendment voting period established by the Board exceeded the mandated 21 day period by about two weeks. When that was not sufficient, the Board illegally attempted to extend it even further. Long time resident and a Board member from 1995 to 2002, James Rogers forced the Board to count only those ballots received in the 21-day time period mandated by the Covenants in effect at the time. 2019– the Board posted proposed Bylaws on the official Bannockburn HOA website – with nothing in the link showing they were only proposed. Worse, the official and then current Bylaws were removed. See2019 Bylaws Issues. Rogers forced the Board to remedy these problems.
2020– the Board proposed radical amendments the Covenants. While changes are needed to update the Covenants and allow for things like secure electronic notifications and voting, these needs were not addressed. Much worse, the draft Covenants (as of May 9, 2020) effectively allowed ‘back door’ amendments to the Covenants using ‘Rules’ approved by only 2 Board members. See 2020 Covenant Issues for more information. Bannockburn-Watchdog, working through Rogers, was able to get this and many other bad provisions removed from the draft Covenants.
2020 – the proposed amendments the Covenants would have needlessly and irrevocably subjected Bannockburn to ALL provisions of the CCIOA (Colorado Common Interest Ownership Act) rather than the far fewer and much less onerous provisions that currently apply to Bannockburn as a pre-July 1, 1992, HOA. This is just one of the provisions Bannockburn-Watchdog, working through Rogers again, was able to get removed. See 2020 Covenant Issues for more information.
2020 – At their May 13, 2020, meeting, after having been given proof of the 2012 fraud in approving Covenant amendments, the Board voted 6-1 NOT to repudiate or revoke the improperly amended 2012 Covenants. Rogers cast the only vote to inform Members of the problems and correct them. As demonstrated by this vote and prior actions, the Board believe Bannockburn members have no right or need to know and that the Board has no obligation to keep members informed. 2021 – The 2021 Board – which has only one new member compared to the 2020 Board, has repeatedly and steadfastly refused to inform Members of the problems with the 2012 Covenants. Once again, James Rogers has been the only Board member advocating for release of this information.
