The 2012 Covenant ballot included a page allowing voting on amendments to Article V, 3. Animals. This page (see 2012 Animals Ballot) included 3 sections:
- Current Wording – This section contained the wording of the existing and then current Covenants for Article V, 3. Animals.
- Additional Information – This section described how the proposed “Subsections”, if approved, would be added to the “existing Article V, Section 3 with the appropriate lettering.”
- Proposed Wording – This section included proposed wording of an introductory nature and Subsections A through Subsection F. The Subsections allowed for voting on individual animal types.
NONE of the Subsections were approved by 66-2/3% of Bannockburn Resident Owners, as required. Nevertheless, all but Subsection C (goats) were deemed “approved” and added to the Covenants. See 2012 Covenant Vote Summary and 2012 Animals Ballot.
The “Additional Information” section included this statement:
“The Subsections that are approved will be re-lettered and added to the existing Article V, Section 4 with the appropriate lettering.” (Underlined bold emphasis added.)
Although NONE of the Subsections were properly approved and NO vote was taken to approve introductory paragraph and in spite of the fact that the “Additional Information” stated approved subsections would be added to “The existing Article V, Section3″, the existing wording was replaced in its entirety with the unapproved proposed wording.
